Administrative Rule 1065-01
Federal/Out-of-State Law Enforcement Operations
Purpose
This procedure is legally required to be in compliance with Chapter 66 (Oregon Laws 2026) and HB 4138 (2026) which requires all public bodies in Oregon to adopt policies related to assistance with federal and out-of-state law enforcement operations.
Statement
All requests made to Linn-Benton Community College employees for assistance or cooperation by a federal law enforcement agency or a law enforcement agency of another state related to investigating, apprehending or arresting individuals shall be referred to the Director of Safety, Loss and Prevention or the VP Finance and Operations in their absences.
The Director of Safety and Loss Prevention will determine the nature of the request for assistance or cooperation and whether the action or conduct requested is required by state or federal law, required by a judicial subpoena issued as part of a court proceeding or other compulsory court-issued process, or relates to the provision of information which is available to the general public and may be provided under the same terms and conditions as the information is available to the public.
All requests for assistance will be evaluated consistent with existing college procedures used to evaluate and respond to external information or assistance requests from outside entities, including governmental requests for information or assistance.
The college may adopt attestation requirements for assistance or cooperation provided to federal or out-of-state law enforcement agencies unrelated to the prohibitions in state law at its discretion.
