Sexual Harassment
Students are protected from sexual harassment by board of education policies, state and federal statutes. Please see the Freedom From Sexual Harassment section of the Student Rights, Responsibilities and Conduct document (pdf) and this statement regarding Sexual harassment/Assault:
Linn Benton Community College takes a proactive stance against sexual harassment/sexual assault per LBCC Board policies regarding Nondiscrimination (Series No. 6090), Sexual Harassment (Series No. 6250), and Harassment (Series No. 6255), as well as the "Sexual Harassment Complaint and Investigation Procedures" (Administrative Rule No. EO27), "Harassment Complaint Procedures" (Administrative Rule No. E028), "Discrimination Complaint Procedures" (Administrative Rule No. E029), and a description of student protection under Title IX of the 1972 Education Amendment.
Annually the college president sends out a cover letter and "Stop Sexual Harassment" brochures to all staff. Brochures are also distributed in a number of areas, including Counseling Center, Student Life and Leadership, Turning Point Transitions Program, Dean of Student Services Office, Human Resources Office and Extended Learning Centers. "Stop Sexual Harassment" posters are placed throughout the campus and at Extended Learning Centers. In addition, LBCC publishes a "Date-Rape" brochure, Housing Rights For Domestic Violence, Sexual Assault, and Stalking Survivors brochure, and displays the "Working to End the Cycle of Violence and Abuse" brochure published by CARDV, Center Against Rape and Domestic Violence. These brochures are available in the Counseling Center and at various locations on campus.
The Drug, Alcohol, Harassment, Violence and Abuse Committee is one of the standing committees on campus charged with helping to ensure that staff and students are informed on related issues. The committee coordinates programming to take a proactive response to eliminate harassment, violence, abuse, and drug and alcohol violations. Further, Linn Benton Community College is represented on the Oregon Attorney General's Sexual Assault Task Force, which is in the process of developing a sexual assault brochure and planning a workshop.
Students who have been the target of sexual harassment/assault on the LBCC campus should contact either the Dean of Student Services (917-4806), or speak with a counselor (917-4780). Employees should contact the college's Affirmative Action Officer at (917-4420). In addition, students and staff may report incidents to the Campus Security Office. The Campus Security Office will assist in notifying the authorities, if the student/staff member requests the assistance.
If a forcible or non-forcible sex offence took place off campus, the police should be contacted to report the incident and to press charges. If a rape is reported to the police within 72 hours and you agree to cooperate in the investigation, you are entitled to "Victim's Compensation" in the state of Oregon. It is extremely important to preserve the evidence. In the case of rape, it is advisable to go to the hospital and get medical care immediately for treatment of any injuries and for other tests. Do not douche, bathe, shower, or change clothes before you go.
The Students' Rights, Responsibilities and Due Process policy and Administrative Rule No. E027: Sexual Harassment Complaint and Investigation Procedures outlines the process for campus disciplinary actions.
During the investigation, the complainant and the accused may bring representation so long as that representative does not interfere with the investigation process. Confidentiality will be maintained to the extent possible while determining the facts of the complaint. Penalties for students who are found guilty of sexual harassment/sexual assault range from a written reprimand to expulsion from Linn Benton Community College. Any form of retaliation, including but not limited to derogatory comments, against individuals making sexual harassment complaints, witnesses, or any other involved employees or students, is against college policy and is strictly prohibited. Retaliatory activities will be treated as a violation of this policy and subject to the same disciplinary measures, up to and including termination/expulsion.
