ASG Constitution
PREAMBLE
We the students of Linn-Benton Community College, do hereby set forth this Constitution to ensure that students, through their Associated Student Government (ASG) and Student Programming Board (SPB), shall have a voice in the affairs of the college by contributing to the social and intellectual development of the student body, providing and promoting opportunities to experience leadership in ways not available through most classroom procedures, creating a liaison between students, faculty, and administration, and thus, assuring that LBCC provides the highest possible quality of comprehensive education.
ARTICLE I: NAME
The student body of Linn-Benton Community College shall be known as the Associated Students of Linn-Benton Community College, hereafter abbreviated to ASLBCC.
ARTICLE II: COLORS AND MASCOT
The symbols of ASLBCC shall be as follows: The colors shall be navy blue, gold and white. The mascot shall be the roadrunner.
ARTICLE III: MEMBERSHIP
Section A: All full, part-time, or non-credit students in attendance at Linn-Benton Community College shall be referred to as members of the ASLBCC and are entitled to vote in ASLBCC elections.
Section B: Associated membership (alumni rights) shall be granted to all former members who have completed at least one quarter, twelve (12) credit hours of work at Linn-Benton Community College. In addition, honorary student body rights may be granted to any person who is considered to have performed distinguished service to the ASLBCC. Honorary student body rights require a majority vote of the Associated Student Government.
Section C: ASLBCC shall continue to be affiliated with, and support, the Oregon Community College Student Association (OCCSA) so long as that organization retains the majority support of the Associated Student Government.
ARTICLE IV: RESPONSIBILITIES OF THE ASSOCIATED STUDENT GOVERNMENT
Section A: The general responsibilities of the Associated Student Government shall be to exemplify the highest ethical standards in academic liaison duties and advocacy activities to LBCC students, staff, Board of Education, and the communities served.
Section B: Specific responsibilities of the Associated Student Government shall be as follows:
1. Act in an advisory capacity to the LBCC Board of Education and administration;
2. Serve as a communication liaison between LBCC students, staff, administration, and faculty;
3. Coordinate the appointment of students to college committees;
4. Receive reports from, and give input to students serving on college committees;
5. Respond to student suggestions, complaints, and other needs;
6. Recognize and aid LBCC special interest clubs and organizations;
7. Assist in the development, coordination, and implementation of a balanced program of activities and events for LBCC students;
8. Be available to assist LBCC in a variety of service areas;
9. Develop and prepare a budget to expend all student fee monies provided to the Associated Student Government. The budget must be approved by the Dean of Student Services. The budget shall be managed in accordance with established college budget procedures. Significant departures from the approved budget will not occur without the approval of the ASG and the Dean of Student Services. In preparing and developing the budget, the ASG shall fully consider, for the student programs portion of the budget, the recommendations of the Student Programming Board. The development of the annual budget shall be finalized not later than six school weeks after the election of the ASG. The Team Coordinator of the Student Programming Board shall be invited to meet with the ASG and the Director of Student Leadership, Outreach and Retention, as this budget is being developed;
10. Will establish a Student Activities Programs budget committee to recommend allocation of (SAP) funds. The committee shall include equal representatives from the Student Programming Board to serve as full voting members;
11. Shall receive monthly reports from the Director of Student Leadership, Outreach and Retention, regarding expenditures that have been made, or are planned, from the approved budget;
12. Make recommendations to the Dean of Student Services regarding the withdrawal or non-renewal of non-athletic talent grant awards. Such recommendations shall come from the Associated Student Government only after the (ASG) has conferred with the Director of Student - Leadership, Outreach and Retention. In all cases involving the withdrawal or non-renewal of a talent grant, the affected student will have an opportunity to meet with the Dean and fully discuss the facts of the case prior to a final decision. Nothing in this Constitution shall be construed to prevent the Dean of Student Services from taking independent action to withdraw or not renew a talent grant for neglect of duty, malfeasance, or misfeasance;
13. The Student Activities Programs committee shall make recommendations to the Dean of Student Services concerning allocation of (SAP) funding to co-curricular programs. All talent grants are subject to the terms and conditions established by the affected department and respective Dean. The Dean of Student Services must, at all times, concur with the terms and conditions attached to non-athletic Talent Grant awards.
ARTICLE V: ASSOCIATED STUDENT GOVERNMENT STRUCTURE
Section A: The Associated Student Government shall consist of eight ( 8) members as follows: three (3) Executive Officers, President -, Vice-President/Center Representative, and Public Relations Secretary. It shall also include one representative from each of the following areas: Humanities; Science and Industry; Student Services and Education; Business; - -and Health.
Section B: The five(-5) student representatives on the Associated Student Government representing academic areas shall be required to major in the academic divisions which they represent or receive written permission from the appropriate Dean to represent that division. The -Student Services and Education- representative may be from any division.
Section C: The duties of the officers of the Associated Student Government shall be outlined in the Associated Student Government Bylaws.
Section D: Each member shall have one (1) vote. The President shall vote only in case of a tie.
Section E: If a vacancy occurs, it shall be the responsibility of the Associated Student Government to fill that vacancy through appointment. Resignations from the (ASG), and from all other student government committees and boards, should be in triplicate: one copy should be delivered to the ASLBCC President, one copy should be delivered to the Dean of Student Services and one copy should be delivered to the Director of Student -Leadership, Outreach and Retention.
Section F: The Team Coordinator of the Student Programming Board shall be invited to all meetings of the Associated Student Government and shall enjoy full discussion privileges. The Team Coordinator shall not have a vote on ASG issues, and is not a member for quorum purposes.
ARTICLE VI: QUALIFICATIONS FOR ASSOCIATED STUDENT GOVERNMENT AND STUDENT PROGRAMMING BOARD
Section A: Officers must be matriculated and enrolled for at least six (6) credit hours at LBCC and maintain a minimum 2.0 GPA or better, both accumulative and per-term.
ARTICLE VII: RESPONSIBILITIES OF THE STUDENT PROGRAMMING BOARD
Section A: The general responsibilities of the Student Programming Board shall be to oversee planning for student sponsored programs brought to LBCC. Such programs may include: lectures, films, dances, recreational events, multicultural events, exhibits, and other such programs.
Section B: Specific responsibilities of the Student Programming Board include:
1. The development of an annual Student Programming Board budget and program/events plan. The proposed budget must be presented to the Associated Student Government President for consideration as part of the budget adoption process set out in Article IV, Section B, and Item 9. Expenditures from the annual budget shall be reported monthly to the Student Programming Board by the Director of Student -Leadership, Outreach and Retention.
2. Consistent with Article IV, Section B, Items 9 and 10 of this Constitution, work with the Associated Student Government to develop and oversee the SAP budget.
3. Other duties, not inconsistent with this Constitution, shall be specified in a set of Bylaws to be established by the Student Programming Board.
ARTICLE VIII: STUDENT PROGRAMMING BOARD
STRUCTURE
Section A: The Student Programming Board shall consist of eight ( 8) students appointed by the Dean of Student Services, after considering recommendations from an interview board to be established by the outgoing members of the Student Programming Board. The body of the (SPB) will consist of the following positions: two (2) Executive Officers--one serving as Team Coordinator and one serving as Multicultural Activities Coordinator. The (SPB) shall also include one (1) specialist in each of the following areas: Campus and Recreation, Health and Recreation, Series Events, -Center Events, - Political Activities, and Intramural Sports.
Section B: The duties of the Student Programming Board will be outlined in the (SPB) Bylaws.
Section C: The students appointed by the Dean of Student Services shall be broadly representative of the LBCC student body, and shall be students in good academic standing at the time of appointment. Student Programming Board appointments shall be made -during the 8th week of Winter Term and shall be for one year. The application and appointment processes will be outlined in the (SPB) Bylaws. The term of office shall begin on the first Wednesday in May.
Section D: The Bylaws of the Student Programming Board shall prescribe the conditions and sanctions, if any, for (SPB)- members that fail to maintain good academic standing. Resignations from the (SPB)-, and from all other (SPB) - Committees and Boards, should be delivered in triplicate: one copy delivered to the Team Coordinator, one copy delivered to the Dean of Student Services, and one copy should be delivered to the Director of Student -Leadership, Outreach and Retention.
Section E: Each Student Programming Board member shall have one (1) vote except the Team Coordinator who shall only vote in case of a tie.
Section F: The ASG President shall be invited to all meetings of the Student Programming Board and shall enjoy full discussion privileges. The President will have no vote on Student Programming Board issues and shall not be considered a member for quorum purposes.
ARTICLE IX: ASSOCIATED STUDENT GOVERNMENT ELECTIONS
Section A: There shall be one (1) regular general election per year which shall be held during the eighth week of classes for winter quarter, on a date specified by the ASG. Special elections may be called by the ASG in accordance with the Bylaws. The ASG may adopt an election code to impose reasonable rules regarding petition timelines, petition forms, ballot counting and other administrative matters. The election code shall be consistent with this Constitution.
ARTICLE X: ASSOCIATED STUDENT GOVERNMENT AND STUDENT PROGRAMMING BOARD TERM OF OFFICE
Section A: Associated Student Government members shall be elected at the regular election held at the end of winter quarter. The term of office shall run for the duration of one year beginning the first Wednesday in May. The only official duty that may be assumed by newly elected (ASG) members and appointed Student Programming Board members, prior to the official beginning of their term, is the budget development responsibility outlined in Article IV, Section B, Item 9. For the purposes of Article IV, Section B, Item 9, the newly elected (ASG) and appointed (SPB) are the bodies authorized to do the work contemplated by the Article. (See Article VIII, Section C for (SPB) term of office).
ARTICLE XI: ASSOCIATED STUDENT GOVERNMENT AND STUDENT PROGRAMMING BOARD MEETINGS
Section A: Regular meetings of the Associated Student Government and Student Programming Board shall be held a minimum of twice (2) each month during the academic year. The President/Team Coordinator may schedule more frequent meetings.
Section B: A quorum shall be required for all Associated Student Government meetings and for all Student Programming Board meetings. A quorum shall be defined as one half plus one of the ASG or SPB memberships.
Section C: Special meetings may be called in accordance to those procedures outlined in the Bylaws of the respective organizations.
ARTICLE XII: PARLIAMENTARY AUTHORITY
The official source for parliamentary procedure for all Associated Student Government and Student Programming Board meetings, elections, and other matters for which parliamentary procedure is necessary for orderly conduct shall be Robert's Rules of Order, Revised, unless specifically superseded by a majority vote of the members present at a particular meeting.
ARTICLE XIII: AMENDMENTS
Section A: Amendments to this Constitution may originate in the Associated Student Government, requiring a two-thirds (2/3) majority vote of that body, or by a petition, stating the proposed amendment and containing two hundred and fifty (250) signatures of ASLBCC members. All proposed amendments must:
1. Be posted in view of the student body for fourteen (14) school days prior to a special election, and be subject to two student hearings during this posting period;
2. Be presented to the student body in a special election within twenty (20) school days of the last day of posting; and
3. To be adopted, the proposed amendment must receive a two-thirds (2/3) majority of the votes cast by the student body.
ARTICLE XIV: RECALL
Section A: Associated Student Government members may be recalled through special elections called for that purpose. Recall petitions must contain two hundred and fifty (250) signatures of ASLBCC members and receive a two-thirds (2/3) majority of votes cast to be effective. The (ASG) may prescribe in an elections code reasonable rules regarding petition timelines, petition form and other administrative matters related to recall elections.
ARTICLE XV: REMOVAL OF OFFICERS
Section A: - Associated Student Government and .Student Programming Board members must maintain good academic standing
(6 credits at LBCC and a 2.0 GPA or better) throughout their term of office. Failure to maintain good academic standing shall result in the officer or representative being placed on probation for one quarter. An immediate vacancy shall be declared if the officer or representative remains on probation for a second consecutive quarter.
Section B: Associated Student Government and Student Programming Board members may be removed from office for neglect of duty, malfeasance or misfeasance. Recommendations for removal must be by a 2/3 majority vote and shall come from (ASG), for the (ASG) member, or (SPB), for the (SPB) member, only after conferring with the Director of Student -Leadership, Outreach and Retention and the student has been provided an opportunity for a hearing before the respective group. The affected student will have an opportunity to meet with the Dean of Student Services and fully discuss the facts of the case prior to the Dean making a final decision.
ARTICLE XVI: NON-DISCRIMINATION
The ASLBCC and the Associated Student Government and the Student Programming Board shall maintain a policy of non-discrimination and promote equal opportunity in programs and organizations for all people.
ARTICLE XVII: ADVISOR'S ROLE
The Director of Student -Leadership, Outreach and Retention shall serve as the advisor to the Associated Student Government and the Student Programming Board.
ARTICLE XVIII: BYLAWS and ELECTION CODES
Section A: The Associated Student Government and the Student Programming Board shall each develop a set of Bylaws to guide day-to-day operations. The original Bylaws for each organization shall be available to the student body. Amendments to the Bylaws shall be posted for 14 school days and at least two hearings on the proposed Bylaws, open to the student body, must be held during the posting period. Adoption by the ASG or Student Programming Board shall be by a 2/3 vote of that respective body at the next regular meeting after the expiration of the posting. The Associated Student Government shall also be authorized to adopt an election code to govern student elections. The election code shall be adopted, and amended, in the same manner as prescribed for the Bylaws.
