Constitution and By-Laws

 

ARTICLE I

Name

Section 1.        The name if the association shall be the Linn- Benton Fire Training Council.

Section 2.        This association is organized as a regional organization, consisting of Benton and Linn Counties.

Section 3.        This association in nondiscriminatory in sex, race, religion, color, creed, and/or age as long as that age us acceptable by the fire service unit they represent.

Section 4.        This association shall be a member of The Oregon Fire Instructors Association (O.F.I.A.), a statewide organization.

 

ARTICLE II

Objectives

Section 1.        The objectives of this association shall be:

(a)   To unite in a regional organization those persons engaged in, affiliated with or promoting fire service training and education.

(b)  To promote fire service training and education.

(c)   To investigate, determine and support standards of fire service training and education.

(d)  To encourage and support both state and federal legislation for fire service training and education.

(e)   To investigate, determine and enact the continued advancement of fire service training and education in Benton and Linn Counties.

(f)   To encourage and support the Oregon Fire Instructors Association, the statewide organization.

(g)  To advise Linn-Benton Community College of local fire service training needs and promote fire service training through the college.

 

ARTICLE III

Membership

 Section 1.        Any person who supervises, coordinates, or instructs in fire related training may pay the designated dues and become an active member.

Section 2.        Any single organization may have more than one active member but shall have only one vote when necessary to decide issues.

Section 3.        Any person who interested in fire training and education but not active in fire training may pay the designated dues and become an associate member.

Section 4.        Members if this organization automatically become either active or associate members of the O.F.I.A.

Section 5.        Questions on whether and individual should be an active or associate member shall be resolved by the Executive Board, who will use guidelines set out by the O.F.I.A.

 

ARTICLE IV

Dues

Section 1.        The dues structure shall be recommended by the Executive Board, and approved by the voting members.

Section 2.        The Secretary-Treasurer shall be responsible for the collection of all dues.

 

ARTICLE V

Officers

Section 1.        The officers of the association shall be: President, Vice President and Secretary-Treasurer.

Section 2.        All officers of the association shall take office after the June meeting of this association, and serve until their successors are elected and installed.

 

ARTICLE VI

Elections of Officers

 

Section 1.

(a)

A slate of candidates for the offices of this association shall be submitted by the Executive Board at the association meeting which shall be no later than April 30, and the slate shall be submitted for election in June.

 

 

(b)

Nominations of officers shall be open to the general membership at the June meeting.

 

 

(c)

The officers shall be elected for a term of one year and shall be eligible for re-election.

 

 

(d)

In case of vacated office, a successor shall be appointed by the Executive Board to serve the remainder of the term.

 

 

(e)

Representatives to the O.F.I.A. shall be selected from (or by) the Executive Board.

     

 

ARTICLE VII

Executive Board

Section 1.        There shall be an Executive Board consisting of the three officers of the association.

Section 2.        It shall be the duty of the Executive Board to take the initiative in determining the policies of the association and to carry out the objectives of the association.

Section 3.        The Executive Board shall designate the bank for the business of this association and shall be responsible for the expenditure of the funds of this association.

Section 4.        Special schools and/or emergency situations may be handled by the Executive Board when between meetings of the membership.

 

ARTICLE VIII

Meetings

Section 1.        This association shall meet regularly, generally on a monthly basis, at L.B.C.C. on dates and times scheduled by the Executive Board.  Other formal meeting dates will be set by the membership or Executive Board as the need arises.

Section 2.        The Executive Board of this association shall meet as the need arises.

Section 3.        The President shall preside over all meeting of the association and the Executive Board.

Section 4.        In the absence of the President the Vice-President shall preside.

Section 5.        The rules contained in Robert’s “Rules of Order” shall govern in all cases wherein they do not conflict with the rules of this organization.

Section 6.        The Executive Board shall formulate and maintain a proper order of business feasible for the association and re-adjust as necessary.

Section 7.        Meeting attendance shall be in person or by a membership approved electronic method.

 

ARTICLE IX

Business

Section 1.        The President shall appoint all committees of this association and these committees shall serve a one year tem or until their function is complete.  The Executive Board may appoint members to fill vacancies that occur during the year.  These committees include, but are not limited to:  advisory boards, Fire Standards and Accreditation committees, and Visual Aids Library committees.

 

Section 2.

(a)

The Secretary-Treasurer shall be the custodian of the funds of the association which shall be deposited in the bank designated by the Executive Board, and paid out only on the order of the Executive Board.  The Secretary-Treasurer shall keep an itemized account of all receipts and expenditures, file vouchers of all payments, and present a full report at each formal meeting of the association.  All funds shall be dispersed by the signature of an officer or member designated by the Executive Board. A twenty-five dollar ($25.00) petty cash fund may be kept by the Secretary-Treasurer for use in postage, purchasing stamps and other miscellaneous items approved by the Executive Board and the membership.

 

(b)

The Secretary-Treasurer shall keep a true and accurate record of all meetings of the association and the Executive Board, notify members of special meetings, attend to organizational correspondence and perform all other duties belonging to the office of Secretary-Treasurer.

 

Section 3.

(a)

Members of the Executive Board shall be reimbursed an approved amount for their expenses incurred while on official business of this association.

 

(b)

The representatives of Linn-Benton Fire Training Council while attending to their duties at the O.F.I.A. shall be assisted financially as approved by the membership and the Executive Board.

 Section 4.        All expenditures of this association must be approved by a two-thirds (2/3) majority vote of the membership present at the meeting.

 

ARTICLE X

Amendments

Section 1.        Amendments, deletions or additions to the constitution and by-laws of this association shall be made only by a two-thirds (2/3) majority vote of the members present at a regularly constituted meeting.  No propositions to amend, delete, or add shall be acted upon unless written notice thereof has been given to the Secretary-Treasurer and members notified at least thirty (30) days prior to the actual vote.  The usual procedure is to submit in writing at a regularly constituted meeting any propositions which are then read to the members present and mailed to all members and the same proposition is then read and acted upon at the next regularly constituted meeting some sixty (60) days after first submission.
